A parent at Slavens School in southeast Denver has filed a federal lawsuit against Denver Public Schools, alleging that the district’s policy allowing teachers to display LGBTQ+ pride flags in their classrooms discriminates against his straight, cisgender, white children. Nathan Feldman claims that the policy is not inclusive of all students, including his children, and has caused them irreparable harm.
According to the lawsuit filed on November 10, Feldman had requested to display a “straight pride” flag in front of his children’s classrooms but was denied by the district. The lawsuit seeks an injunction to stop the district from enforcing the policy and $3 million in punitive damages from the school principal, DPS director of operations, and family constituency specialist named in the lawsuit, as well as from the district, DPS school board, and Superintendent.
The lawsuit alleges that the district’s policy violates the 1st and 14th Amendments to the U.S. Constitution and discriminates against students and staff who are not members of the LGBTQIA+ community.
Feldman and his children are being represented by two Washington D.C.-based attorneys, and the district has not yet been served the lawsuit.
