President Biden’s top attorneys engaged in a heated exchange of letters with top Justice Department officials before and after the release of special counsel Robert K. Hur’s report. Biden’s attorneys accused Hur of violating Department policy and practice for describing Biden as “an elderly man with a poor memory” and holding notebooks containing sensitive information. They insisted that Hur had no reason to put together a 388-page report and criticized Attorney General Merrick Garland for breaking the department’s norms. Garland and his associates supported Hur’s conclusions, stating they were not offered to criticize or demean the President but to explain his state of mind.

Biden’s lawyers raised concerns about the derogatory language used by Hur and his focus on Biden’s personal notes related to classified information. They objected to criticism of Biden for practices that his predecessors openly engaged in and that were not charged conduct. They voiced frustration at the length and detail of the report, arguing that public reports can cause serious harm to their subjects even if they do not result in criminal charges.

Despite lodging complaints with Hur’s office and requesting the opportunity to review and comment on a draft of his report, Biden’s lawyers continued to have vigorous objections about the handling of personal notes on classified information, which they argued could result in irreparable harm to the Offices of the President and Vice President. Their letters to Hur and the Attorney General highlighted the conflict that has erupted between the president’s team and the Justice Department.
